DESCRIPTION:The purpose of this program is to familiarize attendees with basic response practices when encountering violent emergencies. Emergencies involving violence are unfortunately a real possibility in today’s workplace\, school or public venue. This can also include encountering an active shooter on the premises. One of your job responsibilities is to be prepared and know how to respond should such an emergency occur at your workplace. Knowing the proper procedures to follow during an emergency could mean the difference between life and death. Topics include indicators of potentially violent behavior\, how to respond to violent behavior\, how to respond to an active shooter situation and how to react when law enforcement arrives at an active shooter scene.

SUMMARY:The Corporate Transparency Act:  What Companies Involved in Construction Need to Know
DESCRIPTION:The Corporate Transparency Act is a new law that imposes certain reporting obligations on newly formed domestic and foreign companies.  The beneficial ownership reporting will be made to the Financial Crimes Enforcement Network of the U.S. Treasury Department (FinCEN) and be maintained in a registry.  While the purpose of the act is to assist the government in combating illegal activity\, the government is casting a wider net covering legally permissible and innocent conduct that\, if not done in compliance with this statute\, could get those same companies in trouble.  This program will explain what the new law does\, who is required to report under it\, and what needs to be reported.  With single purpose entities and new companies popping up in the construction industry all the time\, this is a can’t miss program to stay ahead of the curve. \n  \nThis seminar is hosted by ABC Member Josh Quinter with Offit Kurman\, PA

SUMMARY:Dealing with Delay: From Contract Negotiations to Claims
DESCRIPTION:This presentation will provide strategies for contractors to protect themselves against the impacts of delays and will identify practical steps that a contractor can take at various stages of a project\, from bid to close-out\, to increase the contractor’s chances of successfully obtaining additional time and compensation.  The strategies presented will include: \n\naddressing schedule requirements at the proposal stage and negotiating contract language to reduce the risk of cost impacts associated with material shortages\, force majeure\, changes\, unforeseen conditions\, delays cause by others\, and non-excusable delays attributable to the contractor;\ndocumentation practices during the performance of the work to avoid contractual pitfalls and effectively supporting claims for additional time and compensation; and\,\nsuccessfully resolving disputes and pursuing claims for additional time and compensation as a result of delay and impacts.\n\n  \nLearning Objectives: \n\nProvide an understanding of basic “delay” related terminology;\nPresent bidding and pre-construction strategies to mitigate delay and impact risk;\nIdentify key contract language posing risk in relation to delays and impacts;\nProvide guidance on why and how certain standard contract language (i.e. “no damages for delay” clauses and liquidated damages clauses) should be modified in pre-contract negotiations;\nOutline steps for effectively documenting delay during construction to support requests for additional time and money;\nIdentify contractual pitfalls to be avoided during construction to preserve the contractor’s rights to additional time and money; and\,\nProvide guidance on proactively addressing disputes during performance of the work and after completion.\n\n  \nPresenter Information: Construction attorney and ABC Member J.T. DESCRIPTION:**THIS IS A SMOKE-FREE FACILITY** \nConstruction Quality Management for Contractors is a certification course sponsored by USACE and NAVFAC. This certification is usually a contract requirement and is an integral component of quality management on Federal government construction projects. \nUSACE in coordination with NAVFAC developed the course that was given the formal title of Construction Quality Management (CQM) for Contractors. \nWhile there is no prerequisite for the class\, students should have a general knowledge of construction processes and Federal construction contracts. \nClass is conducted in one day using the USACE Student Study Guide (provided by the sponsor or facilitator) with a pre and post-test. The class is conducted in person\, utilizing actual examples to stimulate discussion among students. Students are encouraged to ask questions and bring up relevant construction topics. \nFacilitators provided by Building Constructive Solutions are authorized by NAVFAC MIDLANT to deliver the course and issue certificates for candidates who meet the criteria specified by USACE and NAVFAC. \nBuilding Constructive Solutions is a Service-Disabled Veteran Owned Small Business.  BCS is currently a licensed Class A contractor in the Commonwealth of Virginia as well as licensed to provide Professional Engineering services. \nUpon passing the post test\, each student will be provided with an official certificate which is valid for five years. \nLunch will be provided for all attendees
