SUMMARY:ACT 75- Understanding Unauthorized Employees
DESCRIPTION:On October 7\, 2020\, the Construction Industry Employee Verification Act (also known as “Act 75”) went into effect.  Act 75 prohibits a construction industry employer from knowingly employing an unauthorized employee.  Unauthorized employees are defined as those who do not have the legal right or authorization under Federal law to work in the United States.  This seminar provides an overview of Act 75 and employers’ responsibilities\, enforcement of Act 75 and the potential penalties and suspension of license\, and explains what contractors must do to qualify for the Act 75 “safe harbor” that insulates them from liability for Act 75 violations by their subcontractors. \nJeff Venzie will be presenting this seminar. \n \n  \nJeff is the principal and founder of Venzie Construction Law\, LLC\, a law firm based in Exton\, PA\, with a specialized focus on construction law and construction litigation and dispute resolution.  Jeff has been practicing law for 25 years.  Jeff represents owners\, construction managers\, general contractors\, subcontractors\, material suppliers\, and sureties in all aspects of construction law and litigation. DESCRIPTION:Act 72 Seminar Act 72\, or The Construction Workplace Misclassification Act\, (43 P.S. §§ 933.1– 933.17) targets employment practices on construction sites. It imposes criminal and administrative penalties for the misclassification of employees as “independent contractors” at commercial and residential construction sites in Pennsylvania. This seminar will discuss the Act’s definition of an “independent contractor”\, why classification matters to employees and employers\, retaliation provisions of Act 72\, as well as the enforcement of Act 72\, including the imposition of criminal and administrative penalties against employers. \nThis Seminar will be presented by Julie Pfaff. \n \nJulie is an attorney at Venzie Construction Law.  For over 17 years\, Julie has represented Fortune 500 companies\, state agencies\, mid-sized companies\, small businesses\, and individuals in a variety of litigation and environmental matters including contract disputes\, construction claims and defects\, mechanics’ liens and stormwater management issues.  Julie also counsels clients on a variety of employment law matters.  In addition to her law practice\, Julie is an adjunct professor at West Chester University teaching business and commercial law\, employment law\, and public speaking.  Julie began her legal career as a clerk for the Honorable Juan R.
