SUMMARY:ACT 75- Understanding Unauthorized Employees
DESCRIPTION:On October 7\, 2020\, the Construction Industry Employee Verification Act (also known as “Act 75”) went into effect.  Act 75 prohibits a construction industry employer from knowingly employing an unauthorized employee.  Unauthorized employees are defined as those who do not have the legal right or authorization under Federal law to work in the United States.  This seminar provides an overview of Act 75 and employers’ responsibilities\, enforcement of Act 75 and the potential penalties and suspension of license\, and explains what contractors must do to qualify for the Act 75 “safe harbor” that insulates them from liability for Act 75 violations by their subcontractors. \nJeff Venzie will be presenting this seminar. \n \n  \nJeff is the principal and founder of Venzie Construction Law\, LLC\, a law firm based in Exton\, PA\, with a specialized focus on construction law and construction litigation and dispute resolution.  Jeff has been practicing law for 25 years.  Jeff represents owners\, construction managers\, general contractors\, subcontractors\, material suppliers\, and sureties in all aspects of construction law and litigation. He counsels clients through project management issues and disputes that arise during construction with an eye not only toward protecting his client’s rights and remedies\, but also to formulate and implement a strategy that puts the client in an optimal position to prosecute or defend any post-completion litigation.  Jeff also serves as an arbitrator in construction disputes.  Jeff is a Fellow of the Construction Lawyers Society of America and has been recognized by Pennsylvania Super Lawyers as a top attorney in the area of construction litigation in 2019\, 2020 and 2021.

DESCRIPTION:ABC Member Davis Bucco Makara & Dorsey & Construction Risk Partners will be hosting a seminar on Owner Controlled Insurance Program/Contractor Controlled Insurance Program/Subcontractor Default Insurance \nInsurance coverage is as essential as having qualified labor and equipment to perform a construction project.  Sometimes this insurance is offered through Owner Controlled or Contractor Controlled insurance Programs.  These can provide benefits but also anticipated risks for program participants.  This course will discuss the mechanic’s of these programs\, how they are managed\, and what legal risks they do and do not cover.  This course will also examine the growing use of Subcontractor Default Insurance as an alternative to bonding projects.  SDI can provide an important avenue of recovery when enrolled subcontractors default\, while also creating broader opportunities for non-bondable subcontractors to participate in larger projects.
